James Q. Wilson is Collins professor of management and public policy at the University of California at Los Angeles. He is the author of Moral Sense, and more recently, Moral Judgment. Wilson reviews and criticizes many of Andrew Sullivans contrasts in favor of same-sex spousals. Rejecting Sullivans objections, Wilson reaffirms the conservative argument that permitting same-sex unions would jeopardize the institution of marriage at a season when it is already weakened by the widespread acceptance of disjoint and single-mother households.
Wilson also questions Sullivans premise that permitting same-sex marriages would lend perceptual constancy to gay relationships. He believes that we have no proof that homosexual marriages would create stability; nor have we any evidence that pemmitting them wont further destabilize straightaway marriages. Given these uncertainties, Wilson argues against same-sex marriage. In the first case to which he refersâ"the Hawaiian caseâ"a lower court in Hawaii command on December 3, 1996 that the state of Hawaii could not wax that it had a Ncompelling interest in sustaining discrimination against same-sex couples who sought marriage licenses. Thus the Hawaiian Supreme Court will be asked to affirm its 1993 decision, Baehr v. Lewin, in which it judged that a marriage license could not be denied to a same-sex couple unless the state could first base a compelling interest that might justify change marriage licenses to heterosexual couples.
